Budget 2011 - Tax Plus Special

Chancellor George Osborne unveiled his Budget on Wednesday 23 March 2011. In response, the team at Mercer & Hole has published a Special Edition of Tax Plus which analyses the issues raised. It can be accessed by clicking here.

Pension Governance Ranks High As a Priority

As this blogger, Dr. Susan Mangiero, has pointed out repeatedly since the March 2006 inception of www.PensionRiskMatters.com, pension governance counts.

There are numerous ways to quantify the positive impact of governance done well. By extension, the costs of poor pension governance can throw cold water on growth in corprorate earnings and free cash flow. As a result, not only can plan participants suffer but so too can shareholders and creditors should bad employee benefit plan decision-making depress the value of company issued securities.

In a recently issued survey, Towers Watson finds that four out of ten employers "expect to devote more time addressing retirement plan governance issues over the next two years." Reasons cited include the expense of providing benefits, along with more regulatory complexity. Investment volatility was another identified catalyst.

While the in-depth study is not yet published by its sponsor, Towers Watson, it will be interesting to explore later on why more than half of respondents acknowledge the importance of compliance but "only one in four (26%) schedule regular compliance reviews."

Statutory Residence Test and Remittance Basis Change Consultations issued

The framework for the long awaited statutory residence test is set out in the consultation document issued on Friday 17 June. In a different document of the same day, the proposed changes to the remittance basis rules were also announced. I am pleased to say that both documents are clear and straightforward.  So what are the main points?

The residence test is to be comprised of three parts: Part A Conclusive Non Residence: Part B Conclusive residence and Part C which operates as a tie breaker. The test relies on only four factors other than days of presence which removes nonsense about sports clubs and Wimbledon fortnight etc. The connection factors are:

  • Accommodation
  • Family residence
  • Substantive UK employment or self employment
  • Past residence position

In the tie breaker the more connecting factors with the UK, the fewer days can be spent here before triggering residence. It will also be a slightly different test for leavers than arrivers so it will be a little more difficult to be treated as leaving the UK unless you actually significantly reduce your links here. The tests very broadly aim to encapsulate the current position so that there should be few people where the status changes, but we will be considering all of our clients and explaining to them whether and how they will be affected. It is intended that the new rules will apply for the 2012/2013 tax year.

The Non Dom paper sets out the rules for a tax free remittance to the UK to invest in UK business. It is intended that any remittance to invest in a UK trading or commercial letting business will not attract a tax charge. The consultation paper seeks views as to whether listed companies should be included and whether only new shares should be included or existing ones as well. Only companies will be permitted - not partnerships or trusts but overseas vehicles will be included as possible remitters without penalty. The paper also includes proposals for the simplification of foreign currency and nominated income bank accounts the two last areas have been the subject of much criticism from the Tax Faculty and others in representations I have been involved with. It is very pleasing to see a government response taking our views into account and our initial reaction is a positive one. We will be reviewing the papers in detail and formally responding to the consultation in due course as well as expanding on the analysis of the proposals.

Great News!

The DWP has agreed to fund the TUC’s Pensions Champions project for another year. This means that we will be able to build on the progress already made, significantly increasing the number of Champions. More Champions will mean assistance for many more working people in unravelling their pensions and, where necessary, taking steps to improve their retirement income.

Recruitment and training

The TUC now has a database of over 450+ individuals who want to become Pensions Champions, built up through leafleting and promotion on TUC and trade union websites. We aim to substantially increase that number through further publicity. Around 200 individuals have already attended the 3-day Pensions Champions at work course, provided through Unionlearn and offered at Trade Union Education Centres around the country. This is a free course for individuals nominated by their trade union. A number of courses have also been run for members in a single union or employer and further such courses are planned in local government, rail and nuclear industries.

Green light for pensions champions

Prospect is to set up a network of workplace pensions champions to help members handle the many retirement choices they now face. Conference backed a proposal by the national executive to give full support to the TUC's pensions champions project.

People now understood pensions issues much better than in the past, but how they actually work is less well understood, said Audrey Uppington, moving the NEC motion. The TUC project aimed to explain to members at work the options available to them, she said. It includes a pensions website and the facility for members to build up their own personal pensions profile.

EC formal request for the UK to amend its anti-avoidance legislation

On 6 December it was announced that the UK is planning to change two key anti-avoidance provisions: the rules governing transfers of assets abroad and the attribution of gains made by non-resident companies. Apparently proposals will be published for consultation around the time of Budget 2012 with a view to enactment in the 2013 Finance Bill.

The reason for this is that, in February 2011, the EC announced that the existing UK legislation infringed the EU Treaty. The issue is that the law discriminates by taxing the shareholders of a non-UK resident company on the income and gains made by that company for shareholders of a UK resident company. 

The change may have a marked effect on tax planning in that individuals could be entitled to establish a company, including one holding investments, to take advantage of lower corporation tax rates available in some other states in the EU or EEA. In reality, this type of planning is likely to be undertaken only by wealthy individuals because of the costs involved in establishing a company properly. 

The question really though is how far HMRC will go in changing the UK law. Historically it has made only minor changes in these circumstances. It has a strategy of taking a strong position on where to draw the line. We will have to wait – and hope.

Aging Around the World: Economic and Political Realities

In "Shock of Gray: The Aging of the World's Population and How it Pits Young Against Old, Child Against Parent, Worker Against Boss, Company Against Rival, and Nation Against Nation," Ted C. Fishman states that "when a society does not have enough young people, it is forced to change, often in surprising ways." He explains that in forty years, the number of centenarians will exceed three million persons versus 182,000 persons who were older than 100 years in 2000. Moreover, family size is shrinking in many countries at the same time that relatives are geographically dispersed.

Drawing on trends in countries that include China, Japan, Spain and the United States, this best-selling author suggests that businesses and individuals will confront unprecedented challenges as relates to both economics and politics. For one thing, numerous companies jettison older employees (perhaps by offering early retirement) at the same time that having them work more years can be a societal plus (versus having younger workers pay higher taxes to fund programs for a larger and fast-growing cohort of seniors). Second, aging and globalization go hand in hand with lower cost immigrant workers representing a bigger proportion of senior caregivers. Third, if unemployment rates continue to plague youth around the world, economic pressures will disproportionately hit those who are working.

This blogger has long commented on the radically changing demographics in the United States and elsewhere. As with any crisis, innovators tend to rise to the challenge of providing solutions for profit. Already, entire industries such as travel, health care and financial services are segmenting targets by age. However, not surprisingly, those with means have the greatest appeal as potential customers. That means that those less endowed could end up fighting for a smaller sliver of available public goods, especially as nations decide how best to deal with mounting national debts by scaling back on safety net outlays.

Fishman offers that age may be less a chronological phenomenon and more a situation where one should be better categorized by his or her dependency on others. With nearly 80 million people turning 65 this year in the USA, understanding the economic and sociopolitical dimensions of aging is paramount.

One stated solution to the aging crisis is for people to work longer, something that is plausible, especially for those with education who can contribute to a service sector with ease. Staying healthy and saving as much as possible are two other solutions put forth by the interviewees.

Co-Leading Pension Risk Management Workshop in Orlando

I am off to Orlando to address the Florida Public Pension Trustees Association about pension risk management. I will be joined by an esteemed colleague, Dr. Michael Kraten, in a presentation about the fundamentals of enterprise risk management (including the famous COSO cube) and the role of the service provider in creating hedging programs and vetting asset managers who use derivatives. The workshop will include two case studies about foreign currency overlay programs and investing in hedge funds and private equity funds, respectively.

Having addressed the Florida Public Pension Trustees Association ("FPPTA") several times before about pension risk management, I am impressed with its commitment to fiduciary education about investment best practices.

Company cars - fuel rates

 

HMRC has announced new fuel rates for company cars from 1 June 2011. 

For one month from the date of change, employers may use either the previous or new current rates, as they choose. The new rates are:

Engine Size                           Petrol                         LPG

1400cc or less                        15p                           11p

1401cc to 2000cc                   18p                           13p

Over 2000cc                            26p                            18p

Engine Size                           Diesel

1600cc                                      12p

1601cc to 2000cc                   15p

Over 2000cc                             18p

Petrol hybrid cars are treated as petrol cars for this purpose.

HMRC has stated that the rates will now be reviewed four times a year. Any changes will take effect at the beginning of each calendar quarter – on 1 March, 1 June, 1 September and 1 December and will be published on the HMRC website shortly before the date of change.

Great News!

The DWP has agreed to fund the TUC’s Pensions Champions project for another year. This means that we will be able to build on the progress already made, significantly increasing the number of Champions. More Champions will mean assistance for many more working people in unravelling their pensions and, where necessary, taking steps to improve their retirement income.

Recruitment and training

The TUC now has a database of over 450+ individuals who want to become Pensions Champions, built up through leafleting and promotion on TUC and trade union websites. We aim to substantially increase that number through further publicity. Around 200 individuals have already attended the 3-day Pensions Champions at work course, provided through Unionlearn and offered at Trade Union Education Centres around the country. This is a free course for individuals nominated by their trade union. A number of courses have also been run for members in a single union or employer and further such courses are planned in local government, rail and nuclear industries.
